How Debt Counselling Works
The Debt Counsellor acts on behalf of a consumer to reach an agreement between the consumer and the creditor.
- The Consumer's debt is assessed by a Debt Counsellor based on the information given by the consumer and the Credit Bureau's.
- The process starts with a signed application by the consumer, giving consent to a Debt Counsellor of their choice, to act on their behalf and successfully reach an agreement acceptable to all parties.
- On receipt of a signed application, the Debt Counsellor informs all creditors and credit bureaus of the consumer's application.
- The consumers send out a COB (Certificate of balance) in order to start negotiations.
- A proposal is then drawn up by the Debt Counsellor and sent to all creditors for acceptance thereof.
- A creditor then may accept or make a counter offer.
- After the proposal is accepted and signed by consumer and creditor, the file is then prepared for court.
- A court date/order must be obtained before the 60 days lapse. Should this not be the case, the creditors are entitled to terminate a consumer from the debt review process.
